1. Introduction
Welcome to Pont de l'Art (“the Gallery,” “we,” “us,” or “our”). By accessing our website and using our services, you indicate that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree, you have no right to access or use the Services.
2. Eligibility & Account Registration
The Services are intended solely for persons who are 18 or older. To list artwork, you must register as a Member. To apply, artists or sellers must submit a completed form via WhatsApp or Email, including at least four (4) clear photographs of the work. Upon approval, we will issue a Seller ID and list the artwork under your professional profile.
3. Seller Terms & Authenticity
Artists must only submit original works created by themselves. Third-party sellers (galleries or private collectors) must go through the same verification process and may sell pieces from their own collections. Pont de l'Art does not take responsibility for counterfeit or stolen pieces. Legal ownership must be proven by the seller upon request.
4. Commissions & Pricing
A commission of 20% will be added on top of the listed price for all pieces sold through our site. This commission is used to facilitate the transaction, marketing, and administration of the gallery platform.
5. Packaging & Shipping Liability
The artist or seller is responsible for ensuring that packaging is professionally done for collection by the courier at their own cost. While Pont de l'Art facilitates the transaction, all damages and losses during transit are for the artist or seller’s bill. The buyer is liable for all courier fees to their respected points of destination.
6. Payment Terms
Payment will be remitted to the artist or seller before pieces are collected by the courier, provided the gallery has secured cleared funds from the buyer.
7. Buyer Cancellations & Refunds
Buyers are granted a 48-hour cancellation and refund window after accepting the piece. Should a buyer choose to return the work within this period, the return courier fees will be for the buyer’s bill.
8. Color Accuracy & Disclaimers
We use commercially reasonable efforts to display artwork colors accurately. However, because individual monitors display colors differently, Pont de l'Art is not responsible for color accuracy and disclaims all liability in this regard.
9. Modifications
Pont de l'Art reserves the right to modify these Terms at any time without prior notice. By continuing to use the Services after a modification, you agree to be bound by the updated Terms.
